The growing crisis of grand economic crimes and entrenched structural corruption in Iran has led to a serious erosion of institutional legitimacy, a collapse in social capital, and deepening public distrust in governance. In response, adopting justice-oriented frameworks offers a gradual and effective pathway to rebuild economic order and public confidence. Among these, the concept of Economic Transitional Justice—an emerging yet underexplored model derived from transitional experiences globally—emphasizes the recovery of public wealth, structural reform, and systemic transparency as key pillars of economic restoration through legal and legitimate means.
This paper investigates the legal capacities of Iran to implement a localized model of economic transitional justice. The analysis begins with the conceptual foundations and international precedents of transitional justice, then examines the structural and institutional manifestations of economic corruption in Iran. The study further explores constitutional provisions—particularly Articles 49, 43, 53, and 174—alongside key statutory laws related to administrative integrity, financial transparency, and anti-corruption. Institutional mechanisms such as the General Inspection Organization, the Supreme Audit Court, and the Anti-Corruption Coordination Headquarters are assessed as potential instruments for justice-driven economic reform.
The findings demonstrate that Iran’s legal and religious frameworks—if coherently restructured and implemented—can support a domestically tailored model of economic transitional justice without necessitating a political collapse, thereby enabling a process of endogenous reform.
