چکیده

ماده 522 قانون آیین دادرسی مدنی مصوب 1379 با تعیین شروطی، مطالبه خسارت تأخیر تأدیه از تاریخ مطالبه را به میزان تغییر شاخص سالانه قیمت مجاز دانسته است. با وجود اینکه این ماده درخصوص نحوه صحیح محاسبه خسارت تأخیر تأدیه تصریح دارد، بانک مرکزی هم کلیه شاخص های مورد نیاز برای اجرای ماده مذکور را اعلام کرده است. اما به دلیل شاخص‌های که بانک مرکزی در ستون‌های مختلفی ارائه می‌دهد تفسیرهایی از ماده مذکور در بین محاکم مشاهده گردیده که مطابق آن متوسط شاخص بهای سال قبل بایستی معیار قرار گیرد. این وضعیت منجر به دوگانگی در رویه و ایجاد تفاوت چشم‌گیر در نحوه محاسبه خسارت تأخیر تأدیه شده است که باعث تفاوت فاحش در مبلغ محاسبه شده در اجرای احکام می‌گردد. نتیجه این اختلاف رویه منجر به رأی وحدت رویه شمار 850 مورخ 16/ 5/ 1403 گردیده است؛ پژوهش پیش‌رو از نوع نظری بوده و به شکل توصیفی و تحلیلی و با ابزار کتابخانه‌ای و با مراجعه به کتاب‌ها و مقاله‌ها در پاسخ به این سوال سامان یافته که مطابق موازین حقوقی، برای محاسبه خسارت تأخیر تأدیه بایستی از چه شیوه‌ای استفاده نمود؟ در این پژوهش نگارندگان به این نتیجه دست یافته‌اند که منظور قانونگذار از شاخص سالانه در ماده 522 ق.آ.د.م شاخص‌هایی است که در انتهای هر ماه توسط بانک مرکزی اعلام می‌گردد و روش محاسبه خسارت تأخیر تأدیه به صورت حاصل ضرب مبلغ دین در شاخص مربوط به زمان پرداخت تقسیم بر شاخص مربوط به ماه زمان سررسید دین است.

چکیده English

Article 522 of the Civil Procedure Code of Iran, enacted in 2000, establishes the requirements under which delayed payment Damages (khesarat-e takhir-e tadiyeh) can be claimed based on the annual price index changes from the date of demand. Despite the clarity of this article regarding the proper method for calculating such compensation and the provision of necessary indices by the Central Bank of Iran, discrepancies in judicial interpretations have emerged. These discrepancies stem from the varied indices provided by the Central Bank in different columns, leading some courts to adopt the average annual price index of the previous year as the basis for calculation. This inconsistency in judicial practice has resulted in significant variations in the calculated compensation amounts, creating substantial differences in the enforcement of judgments. To address this issue, the Supreme Court issued Unifying Decision No. 850 on August 7, 2024, aiming to standardize the approach. This theoretical study, conducted through descriptive and analytical methods and utilizing library-based research sources including books and articles, seeks to answer the following question: What is the legally appropriate method for calculating delayed payment damages according to legal standards? The findings indicate that the legislator's intent in Article 522 refers to the "annual index" as the monthly indices published by the Central Bank at the end of each month, and the method for calculating late payment damages is the amount of the debt multiplied by the index of the payment time, divided by the index of the maturity month of the debt.
