شناسایی و کاربرد «اصل احتیاط» در تنظیم روابط تجاری بین‌المللی دولت‌ها و شرکتهای تجاری

چکیده
درحالی‌که اصل احتیاط در حقوق بین‌الملل در اسناد حقوقی مختلفی بیان ‌شده، کاربرد آن با تفاسیر متفاوتی روبه‌رو بوده‌ است. این اصل به‌منظور مشروعیت بخشیدن به اقدامات احتیاطی دولت‌ها نسبت به خطرات بالقوه زیست‌محیطی جدی و جبران‌ناپذیر بنیان نهاده شده ‌است. براساس این اصل، عدم قطعیت علمی مانعی برای عدم انجام اقدامات پیشگیرانه محسوب نمی‌شود. این پژوهش با روش تحلیلی توصیفی به‌دنبال بررسی آثار و کاربرد اصل احتیاط در روابط تجاری بین‌المللی دولت‌ها و شرکت‌هاست. باوجود برخی چالش‌های جدی همانند تعارض ذاتی اصل احتیاط و آزادی تجارت، ابهامات مفهومی و سوءاستفاده دولت‌ها از این اصل برای دستیابی به مقاصد سیاسی و اقتصادی، کاربرد این اصل در این عرصه درحال افزایش است. تأثیر این اصل از طریق وضع استانداردها و ایجاد مسئولیت مدنی (تأثیر غیرمستقیم)، ایجاد تکلیف برای دولت‌ها جهت نظارت بر عملکرد بازارهای تجاری و ایجاد محدودیت برای تولید و واردات محصولات خطرناک برای سلامت و محیط‌زیست (ایجاد تکلیف) و ورود به توافق‌نامه‌های تجاری و رویه قضایی محاکم داوری سرمایه‌گذاری (تأثیر مستقیم) از مهم‌ترین آثار اصل احتیاط در تنظیم روابط تجاری بین‌المللی دولت‌ها و شرکت‌های تجاری به‌شمار می‌رود. به‌نظر می‌رسد که جلوگیری از سوءاستفاده دولت‌ها از این اصل مستلزم شفافیت، استفاده از روش‌های نوین ارزیابی ریسک و توجه به چهار اصل تناسب، حداقل اعمال محدودکننده تجارت، عدم تبعیض و سازگاری است.

While the precautionary principle has been articulated in various international legal instruments, its application remains subject to differing interpretations. Established to legitimize state-led precautionary measures against potential serious and irreversible environmental hazards, the principle stipulates that scientific uncertainty shall not justify postponing preventive action. Using a descriptive-analytical method, this research examines the principle's effects and application within international commercial relations between states and business companies. Despite significant challenges—including its inherent conflict with free trade, conceptual ambiguities, and its misuse by states for political and economic objectives—the principle's application in this arena is increasing. The most significant effects of the precautionary principle in regulating these relations include indirect influence through standard-setting and the creation of civil liability; the imposition of obligations on states to monitor commercial markets and restrict hazardous products, and the direct incorporation into trade agreements and the jurisprudence of investment arbitration tribunals. Preventing the misuse of the principle by states necessitates transparency, novel risk assessment methods, and adherence to the four principles of proportionality, least trade-restrictive measures, non-discrimination, and consistency.
