انقلاب دیجیتال در داوری تجاری بین المللی: بررسی امکان داوری هوش مصنوعی در حل و فصل اختلافات

چکیده
توسعة فناوری‌ در سال‌های اخیر به ویژه هوش مصنوعی ساختار و نحوة داوری را دستخوش تغییرات کرده است. این پیشرفت‌ها هوش مصنوعی را قادر ساخته تا با بررسی و مقایسة آراء قضائی و تطبیق آن با یکدیگر، یک اختلاف جدید را پیش‌بینی نماید. به همین جهت برخی کشورها از این فناوری‌، جهت حل اختلافات جزئی و کوچک بهره می‌برند. نوشتار حاضر بر آن است که به تبیین قابلیت تطبیق چارچوب قانونی موجود در داوری‌های تجاری بین‌المللی، برای داوری‌ هوش مصنوعی بپردازد. هوش مصنوعی به عنوان داور با مشکلات بسیاری مانند‌ فقدان آراء، فقدان توانایی استدلال و توجیه آرا، فقدان بی طرفی و استقلال مواجه خواهد بود. در واقع پیچیدگی‌های داوری و استاندارهای داوری نمی‌تواند توسط هوش مصنوعی بر آورده شود و بهتر است این فناوری در راستای کمک به داوران در حل و فصل اختلافات استفاده شوند. پژوهش در این مقاله با مطالعۀ منابع داخلی و خارجی، با مقایسه و ارزیابی ظرفیت‌های قانونی موجود در داوری تجاری بین‌المللی ، به روش کتابخانه‌ای و به شیوۀ تحلیلی- توصیفی و کاربردی صورت گرفته است.

چکیده English

The development of technologies in recent years, particularly artificial intelligence (AI), has transformed the structure and processes of arbitration. These advancements allow AI to predict new disputes by analyzing and comparing judicial decisions. Consequently, some countries are utilizing these technologies to resolve minor and small-scale disputes. This paper aims to clarify how adaptable the existing legal framework in international commercial arbitration is to AI arbitration.

However, AI as an arbitrator faces several challenges. These include the lack of precedents, the inability to reason and justify decisions, and concerns regarding impartiality and independence. AI cannot address the complexities and standards of arbitration effectively. Therefore, it is more beneficial to use these technologies to assist human arbitrators in resolving disputes. This research was conducted through a library study using an analytical-descriptive and applied approach. It examined domestic and international sources, comparing and evaluating the existing legal capacities in international commercial arbitration .
