چکیده
پیشرفت گسترده فناوری هوشمصنوعی باعث ایجاد چالشهای پیچیده در حوزه مالکیت فکری بهویژه در خصوص کپیرایت خروجیهای تولیدشده توسط هوشمصنوعی شده است. امروزه، هوشمصنوعی آثاری را خلق میکند که در آن دخالت انسان یا حداقل است یا اثر به طور مستقل توسط هوشمصنوعی بدون دخالت انسان تولید میشود. کیفیت برخی از خروجیهای تولید شده توسط رایانهها با آثاری که توسط انسانهای ماهر پدید آمدهاند؛ قابل مقایسه است. افزایش ارزش اقتصادی آثار تولید شده توسط رایانه و نحوه برخورد قانون با انواع جدید خروجیهای ماشین محور، پیامدهای اقتصادی و تجاری گستردهای داشته است. بسیاری از شرکتها شروع به سرمایهگذاری در تحقیقات و استفاده از هوشمصنوعی در مدلهای مختلف کردهاند. انتظار می رود بازار جهانی هوشمصنوعی تا ده سال آینده، سالانه دو برابر شود. بنابراین با تولید آثار ارزشمند توسط هوشمصنوعی صحنه برای مدعیان کپیرایت از جمله برنامهنویس، کاربر و سایر مدعیان، بسیار رقابتیتر شده و به علت ابهام قوانین، حقوق کپیرایت با چالشهای جدی مواجه گردیده است. این پرسش که چه کسی مالک «خروجی» چنین برنامههای ارزشمند است؛ به یک موضوع بحثبرانگیز حقوقی نیز تبدیل شده است. در پاسخ به پرسش یادشده چند گزینه تخصیص مالکیت کپیرایت، مطرح است: هوش-مصنوعی، برنامهنویس، کاربر، ترکیبی ازبرنامهنویس و کاربر و حوزه عمومی. کاندیدای مناسب، فردی خواهد بود که با توجه به شرایط مربوط، استحقاق وی از مبانی حقوقی قویتری برخوردار باشد.

Abstract
The extensive progress of artificial intelligence technology has created complex challenges in the field of intellectual property, especially in regard to the copyright of outputs produced by artificial intelligence. Today, artificial intelligence creates works in which human intervention is either minimal, or the work is created independently by artificial intelligence without human intervention. The quality of some outputs produced by computers is comparable to the works created by skilled humans. By producing valuable works by artificial intelligence and the increase in their economic value, the scene for copyright claimants, including programmers, users and others, has become much more competitive and due to the ambiguity of the laws, copyright has faced serious challenges. The question of who owns the valuable "output" of such programs has also become a controversial legal issue. In response to the above-mentioned question, there are some options for assigning copyright ownership: artificial intelligence, programmer, user, a combination of programmer and user and the public domain. A suitable candidate will be a person whose entitlement has stronger legal foundations according to the relevant conditions.
