Abstract
In the name of God, the Most Gracious and the Most Wise
The optimal structuring of economic relations is achievable only through a prudent and professional linkage between law and economics. One of the key determinants of the success of economic policies is their proper placement within efficient legal frameworks. At the same time, consideration of economic principles and variables is essential for the formulation of sound legal rules governing economic activities and for the effective implementation of the relevant laws. The discipline of “Economic Law” has emerged from this socially grounded interrelationship, shaped by the practical necessities of contemporary societies. Characterized by its interdisciplinary and applied nature—as well as its tendency toward the adoption of mandatory norms—economic law maintains a close connection with public order, and its rules frequently bear the hallmarks of public law. At the same time, in its pursuit of balance in economic relations, economic law also draws upon the doctrines of private law and the innovations of the private sector. Alongside this applied field, commercial law still continues to serve as one of the traditional yet dynamic pillars of private law, playing a central role in organizing the professional activities of merchants, structuring corporate behavior, and regulating commercial transactions.
The “Journal of Economic and Commercial Law Researches” simultaneously pursues the advancement of scholarship in both economic law and commercial law. Remaining faithful to its scholarly mission, the journal has now entered a new phase of academic activity—one marked by the expansion of intellectual horizons, the organization of specialized forums with leading scholars and researchers, and the publication of innovative and practice-oriented studies. The journal’s inclusion in the international EBSCO indexing database—an acknowledgement of its enhanced scientific and methodological rigor—will facilitate the wider dissemination of the country’s scholarly achievements and open new avenues of dialogue with the global academic community in this field.
In light of these auspicious developments, the journal remains committed to advancing its mission by continuing to publish original research and by supporting interdisciplinary and practice-oriented studies, thereby fulfilling its role in the enduring and effective promotion of economic and commercial law scholarship in the country. Now, with divine grace, as the eleventh consecutive issue of the journal is published on schedule in the autumn season, it is fitting to express our sincere appreciation for the dedicated efforts of the esteemed Editorial Board, the invaluable cooperation of the journal’s administrative staff, the meticulous evaluations provided by our distinguished and expert reviewers, and the continued support of the Scientific Publications Center of Shahid Beheshti University. Our deepest gratitude is owed to the refined and insightful authors whose capable pens and profound ideas constitute the very essence of this publication. We hope that this shared endeavor will further enrich the legal scholarship of our beloved Iran and provide a solid foundation for a thoughtful engagement with the complex economic and commercial challenges ahead.
