Algorithmic Arbitration and Digital Judicial Development: The Future of Dispute Resolution in the Age of Artificial Intelligence

Abstract
With the rapid advancement of emerging technologies particularly Artificial Intelligence (AI) and machine learning the field of dispute resolution is undergoing fundamental transformations. One of the most significant manifestations of this shift is algorithmic arbitration, where advanced algorithms replace human arbitrators and conduct the arbitration process in an automated, rapid, cost-effective, and digital manner. This paper adopts a descriptive-analytical methodology and a comparative legal approach to examine the theoretical foundations, legal implications, and judicial consequences of this innovative mechanism. It analyzes the impact of algorithmic arbitration through key judicial development indicators such as efficiency, access to justice, transparency, impartiality, reduction of case backlog, and litigation costs, while drawing on the experiences of countries like Estonia, the Netherlands, China, Singapore, United States of America and European Union. The paper concludes by identifying critical challenges such as algorithmic transparency, legal responsibility, and the right to a fair trial, and offers policy recommendations for the gradual implementation of algorithmic arbitration in Iran including regulatory reform, design of ethical and technical frameworks, development of domestic platforms, and establishment of a specialized supervisory authority.
