Legal Dimensions of Telegram Games; A Case Study of the Hamster Kombat Game

Abstract

In this article, the legal dimensions of Telegram games, particularly the game Hamster Combat, are examined using a descriptive-analytic research method. The aim is to explore challenges such as the legitimacy and financial value of the coins obtained from the game, as well as to identify the legislator's approach to these games. The main questions addressed are: What is the legal nature of mining (coin production) in the new genre of Telegram games within our legal system? Do the coins obtained from such games have financial value before being released into the market? Moreover, do the coins obtained from such games have monetary value before their official release, and are concepts such as gharar (uncertainty) and gambling applicable to these games and the coins acquired? The findings indicate that mining (coin production) in such games aligns with the concept of permissible acquisition (hiyazat-e- mubaḥat), although the authors suggest that establishing a new legal framework would be more appropriate. Furthermore, while the gambling and gharar aspects of these games are rejected due to the purposeful nature of the players, the financial value of the coins obtained is recognized within the framework of the Iranian legal system.
