Abstract

Economic corruption has many diverse examples, each leading to the violation of the fundamental principles governing international trade. To effectively combat the influence of financial corruption in international commercial contracts, it is necessary to instill a responsible attitude in society and provide it with required training. Given that in many cases, the parties to the above contracts agree to resolve potential future disputes through arbitration, it is appropriate to specifically examine the arbitration institution's role in combating the influence of economic corruption. The main question of the present study is: What approach should the arbitration institution adopt to combat examples of economic corruption in international commercial contract? The authors have used a descriptive-analytical method to find a reasoned and documented answer to arbitration procedures. The overall results of the research, while pointing out that the arbitration institution can effectively play a role in combating instances of economic corruption in international commercial contracts by adopting a three-pronged approach, namely adopting an active and positive approach, demanding documents and evidences from the claimant and the respondent, and examining the arbitrability of the dispute, also emphasize that adopting the aforementioned approach is not necessarily inconsistent with the principle of adversarial arbitration
